§1 GENERAL PROVISIONS
1. These Terms and Conditions define the rules for using the online shop operated at arya.cards (hereinafter: the “Shop”).
2. The Shop is operated by: Marcin Lis, ul. Bema 6/1, 31-517 Kraków, Poland, business name: Marcin Lis Sklep Internetowy Arya Cards, NIP (Tax ID): 6762419841, REGON: 368705570, email: contact@arya.cards (hereinafter: the “Seller”).
3. Contracts concluded through the Shop are distance contracts within the meaning of the Polish Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827, as amended).
4. Information published on the Shop’s website does not constitute an offer within the meaning of Article 66 of the Polish Civil Code, but an invitation to conclude a contract (Article 71 of the Polish Civil Code).
5. The Shop sells individual collectible trading cards (singles) for TCG games, including but not limited to Magic: The Gathering, Pokémon TCG, and One Piece TCG. Other related products may also be available.
6. The language of the contract is Polish. This English translation is provided for convenience only; in the event of any discrepancy, the Polish version shall prevail.
§2 DEFINITIONS
a) Customer — any natural person, legal entity, or organisational unit making purchases in the Shop.
b) Consumer — a natural person performing a legal act not directly related to their business or professional activity (Article 22¹ of the Polish Civil Code).
c) Privileged Entrepreneur — a natural person concluding a contract with the Seller directly related to their business activity, but not of a professional nature for them.
d) Order — a declaration of intent by the Customer to conclude a sales contract, submitted through the Shop.
e) Business Day — every day from Monday to Friday, excluding public holidays in Poland.
§3 TECHNICAL REQUIREMENTS
1. To use the Shop, a device with Internet access and a web browser supporting JavaScript and cookies is required.
2. The Shop does not require account registration — purchases are made as a guest.
§4 PLACING ORDERS
1. The Customer places an order by adding cards to the cart, completing the shipping details form, and selecting a payment and delivery method.
2. An order is placed by clicking the “Place order” button, however the sales contract is concluded at the moment the Seller confirms shipment.
3. After placing an order, the Customer receives a confirmation email containing the order number, payment details, and a summary of the purchased cards.
4. Cards are reserved while awaiting payment. Failure to pay within 60 minutes of placing the order results in automatic cancellation and release of the reserved cards.
5. The Seller reserves the right to refuse to fulfil an order if it cannot be completed (e.g., pricing error, item out of stock).
6. The quantity of cards shown on the website is approximate and may not be accurate — final confirmation occurs at the time of shipment.
§5 PRICES AND PAYMENTS
1. Card prices in the Shop are denominated in euros (EUR) and include VAT where applicable.
2. Shipping costs are denominated in Polish zlotys (PLN).
3. The total order cost includes the card prices and shipping costs and is displayed before the order is placed. The Customer selects a single settlement currency, and prices are automatically converted using the previous day’s NBP (National Bank of Poland) exchange rate plus a 2% surcharge.
4. Available payment methods:
a) BLIK to phone — payment to phone number 510625532 (PLN payments only),
b) Bank transfer — payment to the Seller’s bank account (EUR or PLN):

c) Online payment — fast payment processed by payment operator Paynow (mBank S.A.), including BLIK and online transfer (PLN payments only). Payment is processed automatically.
5. For payment methods a) and b), the order number must be included in the transfer title. An incorrect or missing transfer title may delay order processing. For method c), the order number is transmitted automatically.
6. The Customer is obliged to pay for the order within 60 minutes of placing it. For bank transfers, the payment deadline is met at the moment the outgoing transfer is recorded by the Customer’s bank. For online payments (c), the deadline applies to completing the payment process on the operator’s website.
7. The minimum order value (excluding shipping costs) is €1.00.
§6 FULFILMENT AND DELIVERY
1. Orders are processed on Business Days.
2. Order processing time (from payment confirmation to shipment) is up to 5 Business Days.
3. Delivery is currently available only within the territory of the Republic of Poland. Shipping to other European Union countries will be made available in the future — information about expanded delivery options will be published on the Shop’s website.
4. Available delivery methods:
a) DPD Courier — parcel locker / pickup point,
b) DPD Courier — delivery to the specified address,
c) Personal Pickup — available only in certain cases confirmed by the Seller.
5. Delivery costs are displayed during the checkout process and depend on the selected method.
6. After shipment, the Customer receives an email with a DPD tracking number.
7. Cards are packed in protective sleeves and secured against damage during transport.
§7 CARD CONDITIONS
1. The Shop sells collectible cards in defined conditions according to the international grading scale used on the Cardmarket platform:
a) NM (Near Mint) — The card shows no signs of use. Minor, isolated white marks on edges are acceptable. Surface scratches are not acceptable.
b) EX (Excellent) — The card shows minor signs of use. Damage may be visible but is not significant. A few white marks on corners or edges. The surface may have a few minor scratches visible upon closer inspection.
c) GD (Good) — The card shows visible signs of use across its entire surface. Edges and corners have many white marks, and scratches are typically visible on the surface. Wear is caused by normal use of the card.
2. The condition of each card is indicated in its listing in the Shop — if no condition is specified, the card should be assumed to be NM.
§8 RIGHT OF WITHDRAWAL
1. Consumers and Privileged Entrepreneurs have the right to withdraw from the distance contract within 14 days of receiving the goods without giving any reason.
2. To exercise the right of withdrawal, the Customer should inform the Seller of their decision by means of an unambiguous statement (e.g., an email sent to contact@arya.cards).
3. The Customer may use the withdrawal form template provided in Appendix 1 to these Terms, but this is not mandatory.
4. To meet the withdrawal deadline, it is sufficient to send the withdrawal statement before the 14-day period expires.
5. The Customer must return the goods to the Seller without undue delay, no later than 14 days from the day of withdrawal. The cost of returning the goods is borne by the Customer.
6. The Seller shall refund all payments received from the Customer, including delivery costs (except for any additional costs resulting from the Customer’s choice of a delivery method other than the cheapest standard delivery method offered by the Seller), without undue delay and no later than 14 days from the date of receiving the withdrawal statement.
7. The Seller may withhold the refund until the goods have been returned or the Customer provides proof of return, whichever occurs first.
8. The Customer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
§9 COMPLAINTS (WARRANTY)
1. The Seller is obliged to deliver goods free from defects.
2. The Customer should inspect the contents of the shipment immediately upon receipt. Any discrepancies with the product description (e.g., incorrect card condition, missing card, wrong version) must be reported within 5 business days of delivery to: contact@arya.cards, including the order number, a description of the issue, and photographs confirming the discrepancy. Reports submitted within this period will be processed as a priority.
3. Complaints submitted after 5 business days require the Customer to demonstrate that the defect existed at the time of delivery.
4. Collectible trading cards (singles) are considered used goods within the meaning of the Polish Civil Code. The Seller’s liability under statutory warranty (rękojmia) is limited to 1 year from the date of delivery.
5. The Seller shall process the complaint within 14 calendar days of receiving it.
6. If the complaint is upheld, the Seller — by agreement with the Customer — shall replace the defective goods with goods free from defects (if available), reduce the price, or issue a refund.
7. In the event of receiving a damaged shipment, the Customer should contact the Seller immediately, attaching photographs of the packaging and contents. The shipping costs for returning defective goods are borne by the Seller.
§10 INVOICES
1. Upon the Customer’s request, the Seller issues a VAT invoice.
2. The Customer may request an invoice during the checkout process by providing the invoice details (NIP/Tax ID, company name, company address).
3. The invoice will be issued and sent electronically after order fulfilment.
§11 PERSONAL DATA
1. The data controller for Customer personal data is the Seller.
2. Customer personal data is processed for the purpose of fulfilling orders and meeting the Seller’s legal obligations.
3. Detailed information on personal data processing is available in the Privacy Policy on the Shop’s website.
4. The Customer has the right to access, rectify, delete, and restrict the processing of their data, as well as the right to data portability and to object to processing.
§12 OUT-OF-COURT DISPUTE RESOLUTION
1. Consumers may use out-of-court complaint and claim resolution methods.
2. The ODR platform for online consumer dispute resolution is available at: https://ec.europa.eu/consumers/odr
3. For Customers who are not consumers, the competent court for dispute resolution is the court with jurisdiction over the Seller’s registered office.
§13 FINAL PROVISIONS
1. The Seller reserves the right to amend these Terms. Amendments take effect on the date of publication on the Shop’s website.
2. Amendments to the Terms do not apply to orders placed before the effective date of the new Terms.
3. Matters not regulated by these Terms shall be governed by the provisions of Polish law, in particular the Civil Code and the Consumer Rights Act.
4. These Terms are effective from 24 March 2026.
